Ok this is my problem, I was in a relationship with an Egyptian national (we have never been legally married thank god),I brought him to the UK on a family permit in 2015.he has had about 3 ukrc applications refused over the years but in November 2018 we won an apply through the tribunal however in January of 2019 I found out that he is legally married to an Egyptian in his home country and they have 3 children I have of course told the home office of this and that our relationship is no longer. He is still in the UK now and I believe his rights to stay were removed in july but now he is taking me to family court at the end of the month for visitation rights (we have a 3 year old).he is getting the hearing free as he has stated that I have been arrested for DV against him (a total lie) the truth is that I have been abuse physically sexually mentally financially by him since 2013,I am currently working with harbour (DV centre where I live since june/july) and I have a lawyer to help (although she has not been very helpful so far)I report my ex every week on the gov site I've been in contact with my local MP I have sent the HO many emails (around 35+) to complain as to why he hasn't been removed and I get no response at all.what can I do?
Kind regards
Angela
You can tell your story that you were caught up in an elaborate marriage fraud. This is more common in Pakistan than you think. It will be on record and may influence their decision to let his new wife into the UK. If no joy, I would just get on with your life and forget about this man. You will not be the last person to be scammed like this. But the more of these stories they get, the more they will start to see a pattern of deception and do something about these immigration marriage frauds. Good luck.
I did not actually. I will try but what can write to them? We are divorced so he has the right to marry again. The home office did not remove his residence rights it seems so he can do whatever he wants.
His right was never removed. Years ago I talked to a very sympathetic immigration officer and was told he tried for his British passport 3 times and was refused. Your ex husband's records will have been noted. Did you write to the Entry Clearance Officer at the British Embassy in his home country? He will be trying to bring her to the UK.
I have a question please. How did you know that his right to stay in UK was removed? I contacted the home office, they told me that I don't have the right to know...
You do that. If he hasnt already got his ILR then you stand a better chance of deporting him. With the children he will try to use Section 8 of the ECHR act so be mindful of that too. Have you looked at the Bigamy law and discussed this with your lawyer?
Thanks so much,I'll keep pushing the home office I'm writing a letter right now to ask for answers I'll be sending it today so it arrives tomorrow.
I think you have done all I would have advised you to do. Keep pestering the Home Office. Write to Priti Patel at SW1 address. She might be more sympathetic.
